The state of Illinois and Chicago continue the Trump administration on their plans to deploy the National Guard.
“The American people, regardless of where they live, should not live under the threat of occupation by the American army, in particular not simply because their city or their direction of the state fell in favor of a president,” said the trial in their introduction.
In the trial, which appoints both the state of Illinois and the city of Chicago as complainants, the attorney general of Illinois, Kwame Raoul, writes: “The deployment of troops federalized by the defendants in Illinois is manifestly illegal.” He continues: “The complainants ask this court to stop the illegal, dangerous and unconstitutional federalization of the members of the United States National Guard, including the Illinois and Texas National Guard”.
Raoul requests a temporary prohibition order, claiming that the deployment will cause “additional disorders”, “police distrust” of a DHARM to the state economy.
During the weekendA Federal memo obtained by CBS News revealed that up to 300 members of the Illinois National Guard would be federalized and deployed to “protect federal property” and “government staff fulfilling federal functions”.
Illinois Governor JB Pritzker confirmed that the service note and said it was also informed that 400 other members of the Texas National Guard would be deployed in Chicago and Portland, Oregon.
A The federal judge temporarily blocked the deployment of the National Guard in Portland on Sunday.
During a press conference on Monday afternoon, Pritzker has repeatedly decreased what he called “the invasion” of the Trump administration of Chicago, and said that the secretary of the DHS, Kristi Noem and other administration officials, stretched the raids and the military style application to sow chaos which would then justify the deployment of military troops in Chicago.
“The state of the Illinois will use all the levels at our disposal to resist this power entry and bring out the chicago Noem thugs,” said Pritzker. “I am not afraid. I am not afraid. And I will not back down. “”
“The American people, no matter where they live, should not live under the threat of occupation by the American army,” said Ag Raoul. “In particular for the reason that their city or state management fell from the political favor of the president.”
Raoul said the state had brought more than 40 prosecution against Trump administrations so far. He cited the militia clauses of the American Constitution, which give the congress the only power to decide where the troops are deployed, and the posse Comitatus Act which prohibits military troops from participating in the application of civil laws.
“It is unfair to the national guards, it is unfair to the local police and it is certainly unfair to the laws respectful of the laws of Illinois who do not want to be subjected to military occupation,” said Raul.
Raoul said that the only situation in the city or the State which is “out of control” are the glacial agents whose exaggerated department creates a pretext for military deployment, and has cited the own statements of President Trump according to which he wants to use American cities as a military training ground and declared that Chicago “was about to discover why this is called the Ministry of War”.
“I am here to say that the president’s actions are illegal,” said Raoul. “The president has failed to establish that one of the legal conditions existing for his efforts to mobilize his troops of the National Guard here.”
Mayor Brandon Johnson said that the trial sent “a message to the president that Chicago will not be used as a political accessory. Chicago will not be intimidated and will not be silent”.
“Our city has already been confronted at difficult times and each time we have stayed strong, because we kept ourselves together,” said Johnson. “Let us continue to work together to protect our democracy and fight for the future of our country.”
The American Senators of Illinois Dick Durbin and Tammy Duckworth published a declaration in collaboration with other Democrats of Illinois, demanding from Mr. Trump to overthrow his decision to deploy troops of the National Guard.
“We write to urge you to reverse your reckless decision to federate and deploy the troops of the National Guard of Texas and Illinois to Illinois. Your use of soldiers to sow fear and chaos in American cities, including objections of several governors, is unconstitutional and non-American, influences individual rights and states, and threatens to underline military preparation and morale
Pritzker said the courts had given the United States justice ministry until 12 noon Wednesday to meet the trial and that the next hearing will take place on Thursday.
