Explained: what the three bills were presented by Amit Shah mean for the PM, CMS and ministers arrested

The Minister of the Interior of the Union, Amit Shah, presented three controversial bills in the Lok Sabha which propose the abolition of the Prime Ministers, the Chief Ministers and the Central Ministers or the State of their functions if they remain in a state of arrest for 30 consecutive days for serious criminal accusations.

The introduction sparked spectacular demonstrations in the House, opposition deputies tearing copies of the Bills and heading towards Shah’s siege while shouting slogans. Despite the tumult, the bills were referred to a joint parliamentary committee, including 21 members of Lok Sabha and 10 Rajya Sabha, responsible for submitting a report from the first week of the next Parliament session in November.

What do bills offer?

Under the new provisions, any Minister or Head of Government – including the Prime Minister, a chief minister or a minister of the cabinet – would be automatically withdrawn from his functions if:

  • They are accused of an offense liable by five years or more imprisonment.
  • They are arrested and detained for 30 continuous days. On the 31st day of daycare, the minister would be deemed to have stopped taking up his duties.

The three bills were presented

The draft law on the constitution (one hundred and thirtieth amendment), 2025

Seeks to modify the Constitution in order to predict the abolition of ministers, in particular the Prime Minister and the Ministers in chief, in central governments and states under the above conditions.

Key provisions:

For union ministers:

  • Removed by the President, on the Prime Minister’s recommendation, at the latest on the 31st day of detention.
  • If no recommendation is made by then, the minister is automatically deleted.

For state ministers:

Removed by the governor, on the basis of the councils of the chief minister.

For Delhi ministers:

Removed by the president, on the basis of the councils of the chief minister.

For the Prime Minister and the Chief Ministers:

Must resign by the 31st day of daycare or stop holding its functions automatically afterwards.

Reappointment:

There is no bar on resettlement after the release of the guard.

The bill on the reorganization of Jammu-et-Cachemire (amendment), 2025

This bill offers similar provisions for Jammu-et-Cachemire, modifying the J&K Reorganization Act, 2019.

Ministers in J&K:

Removed by Lieutenant Governor, on the advice of the chief minister.

Chief minister J&K:

Must resign by the 31st day of daycare or will be automatically deleted.

The draft law of the government of the Union territories (amendment), 2025

Seeking to modify the 1963 law on the government of the Union territories, which governs Pondicherry.

Key provisions:

Ministers in Pondicherry:

Removed by the president, on the advice of the chief minister.

Pondicherry chief minister:

Must resign by the 31st day or be automatically deleted.

The government has argued that measures aim to meet moral standards in the public service and prevent criminal persons from serious positions of power. Opposition leaders have strongly criticized bills, calling them unconstitutional, a violation of federal principles and an attempt to overthrow democratic mandates through executive overtaking.

The joint parliamentary committee will now deliver on bills before returning to Parliament for the final adoption.
