Delhi High Court orders ECI to allot common symbol to Akhil Bharatiya Jan Sangh for Bihar polls

The Delhi High Court on Thursday (October 9) ordered the Election Commission of India (ECI) to allot a common electoral symbol to the Akhil Bharatiya Jan Sangh for the upcoming elections to the Bihar Legislative Assembly, Bar and Bench reported.

The order was passed by Justice Mini Pushkarna.

The court ordered the party to submit an application to the ECI as per the Election Symbols (Reservation and Allocation) Ordinance.

“Subject to the petitioner’s compliance with the said direction, it is directed that a common symbol be immediately allotted to the petitioner for contesting elections to the Bihar State Assembly,” the bench said.

The Akhil Bharatiya Jan Sangh, registered in 1989 and claiming its origins in the Bharatiya Jana Sangh, had challenged the ECI’s September 1 communication rejecting its request for the symbol. The party argued that the refusal violated its constitutional and statutory rights, citing faulty reasoning and lack of internal conflicts, as claimed by the ECI.

This is the second time the party has approached the High Court after its previous petition led the Court to order the ECI to expeditiously review its August 25 representation. Advocates Pranay Ranjan and Mrigank Prabhakar represented the petitioner.
