Is INDIA bloc planning to move impeachment motion against CEC Gyanesh Kumar, here’s what we know

In a significant political development, the INDIA bloc is considering moving an impeachment motion against Chief Election Commissioner (CEC) Gyanesh Kumar, according to reports. The move comes amid ongoing tussles between the opposition and the Election Commission over a special and intensive revision of electoral rolls in Bihar and allegations of electoral fraud.

Although this decision is in the discussion stage, the opposition parties will meet again and discuss it further, PTI reported.

On the impeachment motion, Congress Rajya Sabha MP Syed Naseer Hussain said, “If it becomes necessary, we will use all weapons of democracy according to the rules.” We haven’t had any discussions (on impeachment) yet, but if necessary, we can do anything. ยป

A CEC can only be removed through indictment. Under Article 324(5) of the Constitution, the CEC can only be removed in the same manner as a judge of the Supreme Court, which requires a motion of dismissal from Parliament.
The opposition has just four days to move the impeachment motion as the monsoon session of Parliament ends on August 21.

In his first press conference after Congress MP Rahul Gandhi leveled allegations of ‘chori vote’ in the 2024 Lok Sabha polls and several opposition leaders flagged issues regarding SIR in Bihar, CEC Gyanesh Kumar on Sunday asked the Congress MP to apologize or back up his claims with a signed affidavit, as required electoral rules.

Gandhi, however, hit back, alleging selective targeting. “The Election Commission asks me for an affidavit. But when Anurag Thakur (BJP MP) says the same thing as me, they don’t ask him for an affidavit,” he said.

Motion to Impeach

As per procedure, the motion requires at least 100 signatures in the Lok Sabha and 50 in the Rajya Sabha to be introduced. A two-thirds majority in the relevant House is required for the motion to pass.

The signed motion is submitted to the Speaker of the Lok Sabha or the Chairman of the Rajya Sabha, depending on where it was initiated.
